Pennsylvania's Uniform Construction Code moves to 2021 I-Codes, with full enforcement now in effect

Pennsylvania's statewide Uniform Construction Code (UCC) moved to the 2021 International Code Council series on 1 January 2026, binding every contractor, designer, and municipal code official in the Commonwealth. The transition window for pre-existing contracts closed on 1 July 2026. As of that date, all permit applications - regardless of contractual status - are reviewed under the 2021 I-Codes as amended by the UCC Review and Advisory Council (RAC).

The code is administered by the Pennsylvania Department of Labor and Industry (L&I) under 34 Pa. Code, Part XIV, Chapters 401 and 403.

How the adoption reached the effective date

The update followed a process that began in October 2021. The RAC approved its final report on the 2021 I-Codes on 12 September 2024, and the Independent Regulatory Review Commission (IRRC) approved the rulemaking on 16 October 2025. Final-omitted rulemaking was published in the Pennsylvania Bulletin on 8 November 2025 (Doc. No. 25-1602), establishing 1 January 2026 as the effective date.

The update had originally been scheduled for 13 July 2025 but was delayed pending IRRC review.

What the 2021 UCC now requires

The adopted package replaces the 2018 I-Code series - itself adopted in 2022 - across the full suite of model codes. The codes now in force under the Pennsylvania UCC are:

• Commercial: 2021 IBC with PA RAC amendments
• Residential: 2021 IRC with PA RAC amendments
• Mechanical: 2021 IMC with PA RAC amendments
• Plumbing: 2021 IPC with PA RAC amendments
• Fuel Gas: 2021 IFGC with PA RAC amendments
• Energy: 2021 IECC with PA RAC amendments

Pennsylvania substantially amends the ICC model codes through the RAC process. One notable RAC decision: the state did not adopt the updated 2021 IECC insulation table, so projects continue to use the 2018 insulation requirements for energy code compliance under the new cycle.

Among the substantive changes carried in from the 2021 ICC base codes, emergency escape and rescue openings under IRC Section R310 now require a clear 36-inch-wide path to a public way - a change affecting residential builders and framers. The 2021 series also introduces updated requirements for structural design, fire protection, mechanical systems, and energy performance across commercial and industrial occupancies under IBC Chapters 16, 9, 28, and the IECC commercial provisions respectively.

Accessibility provisions remain under the 2018 standard

One significant carve-out applies to accessibility. The 2021 accessibility provisions - including the updated ICC A117.1 standard - remain enjoined by a 2022 Commonwealth Court ruling. Until the Commonwealth adopts alternative provisions, accessibility requirements continue to be enforced under the 2018 IBC, Existing Building Code, Plumbing Code, and Swimming Pool and Spa Code, referencing ICC A117.1-09.

Permit applicants and design teams must verify current accessibility enforcement status with L&I before applying 2021 accessibility requirements to any project.

Transition rules and municipal enforcement

Over 90% of Pennsylvania's 2,562 municipalities have elected to administer and enforce the UCC locally. For the remaining municipalities, L&I handles commercial enforcement directly. Individual municipalities may have adopted more restrictive ordinances that shortened the transition window below the statewide six-month allowance; teams should confirm locally.

The transition rules that applied between 1 January and 30 June 2026 are now closed:

• Projects with a design or construction contract signed before 1 January 2026 could proceed under the 2018 UCC, provided a permit application was submitted by 30 June 2026.
• Any permit application submitted on or after 1 July 2026 must comply with the 2021 UCC, regardless of when the underlying contract was signed.

Philadelphia maintains its own construction code as a component of the UCC under the Philadelphia Administrative Code; teams working in the city should verify local requirements separately.

The next triennial review - covering the 2024 I-Code series - is expected to begin in the near term under the RAC process. Given the delays that pushed the 2021 adoption past its original 2025 target, the timeline for the 2024 cycle will be worth monitoring.
